Component: Power Train: Automatic Transmission Defect Summary: VEHICLE DESCRIPTION: PASSENGER VEHICLES. LOCKUP OF THE TRANSFER CASE CAN OCCUR DUE TO INSUFFICIENT LUBRICATION. Consequence Summary: THIS CONDITION CAN CAUSE A LOSS OF VEHICLE CONTROL, INCREASING THE RISK OF A CRASH. Corrective Summary: DEALERS WILL INSPECT THE VEHICLES FOR ADEQUACY OF THE TRANSFER CASE OIL VOLUME, TRANSFER CASE OIL LEAKAGE, AND OPERATIONAL DEGRADATION OF THE TRANSFER CASE MECHANISM. IF OIL VOLUME IS INSUFFICIENT, THE APPROPRIATE AMOUNT OF OIL WILL BE ADDED. IF THERE IS TRANSFER CASE OIL LEAKAGE, AFFECTED COMPONENTS WILL BE REPLACED. IF THE TRANSFER CASE SHOWS OPERATIONAL DEGRADATION, THE TRANSFER CASE WILL BE REPLACED.

I had my Talon fixed back in 2003. The dealer argued that the repair had already been made, and that they didn't have to fix the problem. Unfortunately for the dealer, I knew that this problem is one that must be fixed by the dealer regardless of whether it had been fixed previously or not.
After explaining this to him, and having him disagree to the point of nearly throwing me out of the building, I mentioned that I would be calling the corporation to file a complaint. It was seconds later that he asked me for my keys, and agreed that he would do the work.
From what I have learned from other forums, this is work that must be carried out by the dealer whether or not it had been fixed previously, regardless of how old your car may be. I don't think it would be good to let the dealer see any obvious modifications... Exhaust mods would be very apparent and may work against your case.
